NJ Adopts Ongoing Storm Rule

The New Jersey Supreme Court recently issued a precedential opinion that provides that commercial landlords do not have a duty to remove the accumulation of snow and ice until after the conclusion of a storm.  This is known as the “Ongoing Storm Rule”.  There are 2 exceptions – (1) the commercial’s landlord’s conduct or actions increased the risk to pedestrians on the property, or (2) the danger is preexisting.
